The highlight of 9th Circuit Day was Fajita-gate, a § 1983 suit involving the conduct of three off-duty police officers during an altercation over a bag of steak fajitas. One of the officers involved in the carnal mêlée was Alex Fagan, Jr., who was arrested a few years ago following a brawl with his father, former Police Chief Alex Fagan Sr.
A very nervous attorney for the plaintiff-appellants argued that the City and
Throughout the proceedings Judge Bybee appeared serious, Thomas was his usual thoughtful yet lighthearted self, and Judge Noonan looked a little out of it. (But really, who's to blame him after sitting through Research Corp. v. Westport Ins. Corp.?)

Not to backseat blog, but those of us on the outside could use some general info--like, wtf is 9th Circuit day?
Of course, you would be wise to keep blog control out of alumni hands. Otherwise, this could end up like some other blogs one might mention.
you're an alum and don't know what 9th circuit day is?
its when then 9th circuit holds session at Boalt, hearing 4 oral arguments.
I didn't get a chance to watch Fajitagate but the second case (contract dispute between a p-side firm and local counsel over local counsel's claim to a bonus) made me think that next year, BOA should set up a side room where appellate attorneys give a play-by-play and color commentary. The highlights could be fun:
"Wow, Bob. Here's where appellant has just shot himself in the foot for the third time today: arguing with the judge about what he can decide and what he has to remand isn't going to win him any points."
"You're right, Jane, but you've got to give him points for heart. Even though he didn't file a reply brief and he got smacked around on paralegal salaries, he's still fighting the good fight..."
[Silence]
"Oh damn. Yeah, when the judge basically tells you, 'yes, we understand your argument, we just think it's full of crap,' you might want to try changing tack."
6:21--cut me some slack, I'm old. I graduated way back when Berkeley students had a high bar passage rate (zing!)
It all sounds vaguely familiar though. Wonder how long it has been going on.
has anyone heard whether class ranks will be calculated based on fall 2007 grades?
1:35, the word I've heard is that they will, Real Soon Now. The Registrar's office says they're waiting for the last of the grades to come in.
